State Trucking Legislation Highlights

With an industry as big as transportation spanning across 50 states and three countries, it can be hard to keep up state by state with some current legislation and regulations going on. Here are some updates going on throughout the US.

Delaware - The Delaware Senate voted to advance a bill that would enact a preemptive ban on driverless trucks. SB46 would prohibit vehicles who’s gross weight is over 26,000lbs from traveling on Delaware roadways for testing purposes, transporting goods, and transporting passengers if it does not have a driver physically present in the vehicle.

Florida - Despite Florida already having rules for big trucks to remain out of the far left (Hammer) lane, two Florida bills wound amend the current laws to prevent all vehicles from “continuous movement” in the left lane

Kansas - While trucking we’re always on the lookout to move over when emergency vehicles are on the shoulder, but a new Kansas law amends this to now apply to any vehicle stopped that are displaying hazard lights or warning indicators.

Missouri - Missouri takes on predatory towing by enacting procedures set to crack down on non consensual towing. It will temporarily prohibit towing companies from performing non consensual tows if they’re violating the law. Along with a committee being formed it will permit the driver or owner to request a specific towing company. If fees are disputed the vehicle will be released, and per pound charges will be prohibited. This one is huge!

New Jersey - The NJ Senate Transportation Committee voted to advance a bill that would allow weigh-in-motion technology before bridges. Allowing a margin of error of 5% if no violation is found then trucks will be given the bypass weigh station signal

New York - Two New York bills could raise the speed limits for trucks. Statewide it currently sits at 65, but one House and one Senate bill would raise it to 70mph

North Carolina - Following Missouri, NC has a House Bill that would reform towing where non consensual towing can only be done by companies given state issued permits, it would establish a towing fee maximum, and specifically stop the charging of storage or “handling cargo” fees.

Pennsylvania - The Commonwealth has a bill that would reimburse truck drivers for tolls incurred when transporting good to and from port facilities in the state along the Pennsylvania Turnpike

Texas - Despite autonomous vehicles roaming on Texas Highways SB2425 would update the state’s definitions for autonomous vehicles and create additional terms related to their use. Prohibitions created would include operation without a human driver.

DOT Compliance Corner - English Proficiency Requirements to be Enforced

COMMERCIAL DRIVERS MUST SPEAK ENGLISH OR BE PLACED OUT OF SERVICE (STARTING JUNE 25TH!)

The Commercial Vehicle Safety Alliance (CVSA) released a news brief indicating that, after an emergency board meeting, they will be re-implementing an English Language proficiency requirement for commercial motor vehicle drivers. Most people are aware that 391.11(b)(2) has always been a federal requirement that all interstate drivers had to at least read and speak English sufficiently to have conversation. It has always been a standing requirement under Driver Qualification, and then it was also entered as an Out of Service on April 1, 2012. However it was removed from the criteria on April 1, 2015, just three years later after research and trucking advocacy groups petitioned for it to be removed.

But after President Trump issued the executive order last Monday titled "Enforcing Commonsense Rules of the Road for America's Truck Drivers" requiring the enforcement of the English language requirement, it also directed Secretary of Transportation Sean Duffy to have FMCSA establish a new guidance that will establish the enforcement procedures used to ensure compliance of 391.11(b)(2) during roadside inspections.
