Trucking gets Center Stage in Pennsylvania Legislation
The Pennsylvania statehouse dialing up some trucking legislation that could impact drivers across the Commonwealth, here’s the main highlights:
🛑 Idling Law Changes on the Table
Since 2009, PA law has limited diesel trucks over 10,000lbs to just 5 minutes of idling per hour, with fines between $150 to $300 for violators. The rule also holds property owners of loading/unloading sites accountable if trucks idle too long on their property.
Now, Rep. Tina Pickett (R-Bradford/Wyoming) is pushing HB954, which would remove the penalty risk for business owners and put the responsibility solely on drivers. Pickett says it’s "unrealistic for a busy business owner to constantly monitor" trucks on their property. The bill is currently in the House Transportation Committee.
🔑 Second Chance for Lifetime CDL Bans
In a major development, the PA House passed HB960, a bill that could offer a path to CDL reinstatement for drivers with lifetime bans, specifically those banned due to DUI or chemical test refusals.
Key requirements for reinstatement:
Completion of a state rehab program
Approved driver improvement course
$100 restoration fee
10+ years with no disqualifying offenses
Proof of citizenship or permanent residency
However, drivers with three or more DUI offenses while driving commercially won’t qualify. If passed, the changes would take effect in 30 months.
Supporters say this could help strengthen the driver workforce and aid the economy, given trucking moves 72.6% of the nation's freight by weight.
The bill now heads to the Senate Transportation Committee.
🎉 Truck Driver Appreciation Week in PA
Lastly, PA lawmakers are recognizing the hard work of drivers. HR139, sponsored by Rep. Kerry Benninghoff (R-Bellefonte), would officially designate September 14-20 as Truck Driver Appreciation Week in Pennsylvania.
Benninghoff highlighted that trucking accounts for 1 in 15 jobs in the state, with drivers navigating tough conditions and long hours to keep goods moving.
The resolution cleared the House Transportation Committee unanimously and moves to the full chamber.
🚛 Takeaways: If you’re driving in Pennsylvania, stay tuned. Idling laws are another issue that misses the mark. Trucks aren’t idling to give a middle finger to the environment, it’s so drivers can have some level of comfort while they sleep, or kept at shippers/receivers for hours on end. Reinstating CDL’s could be a double edged sword, but I am a firm believer in redemption. And if you’re going to have an Appreciation Week for Truckers, why not do a little bit more to help them, like reduce the cost of the Pennsylvania Turnpike, and add more truck parking!
